Terms of Service

1) Acceptance of terms

By accessing or using the Services (the EduPlay Studio desktop application and the website/services hosted at eduplay-game.web.app), you agree to be bound by these Terms and our Privacy Policy.

2) Eligibility

You must have the legal capacity to enter into these Terms. If you are using the Services on behalf of a school or organization, you represent that you have authority to bind that entity.

3) The Services

• EduPlay Studio is a desktop application for creating educational games/projects and exporting/publishing them for use in PowerPoint and on the web.
• The Website hosts support documentation, PowerPoint add-in resources, and a game viewer that may load published content by identifier (e.g., a game_id).

4) User content

• Ownership: You retain ownership of your Content.
• License to operate: If you publish/upload Content so it can be accessed via the Website or add-in, you grant us a non-exclusive, worldwide license to host, store, reproduce, transmit, and display that Content solely to operate and provide the Services.
• Responsibility: You are responsible for your Content and for ensuring it does not violate laws or third-party rights (including copyright, privacy, and publicity rights).

5) Acceptable use

• Do not use the Services to upload or distribute illegal, harmful, infringing, or abusive content.
• Do not attempt to bypass security, probe vulnerabilities, or disrupt the Services (including denial-of-service attacks).
• Do not use the Services to collect personal data about others without appropriate permissions and legal basis.

6) AI features (optional)

• If you use AI features (e.g., Edubot), your inputs and attachments may be processed by third-party AI Providers.
• You agree not to submit sensitive personal data unless you have a lawful basis and appropriate permissions.
• AI outputs may be inaccurate. You are responsible for reviewing outputs before using them in teaching materials.

7) Third-party services

The Services may rely on third-party platforms and providers (e.g., Microsoft Office/PowerPoint, hosting and database providers such as Firebase, and AI Providers). Your use of those third-party services is subject to their terms and policies.

8) Intellectual property

Except for your Content, the Services (including software, design, and documentation) are owned by EduPlay and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as permitted by law or with prior written permission.

9) Disclaimers

• The Services are provided “as is” and “as available”.
• We do not warrant uninterrupted, error-free, or secure operation.
• We do not warrant that Content displayed via the viewer or add-in will be compatible with every environment, device, or Office configuration.

10) Limitation of liability

To the maximum extent permitted by law, EduPlay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or goodwill arising from or related to your use of the Services.

11) Indemnification

You agree to indemnify and hold EduPlay harmless from claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of your Content or your violation of these Terms.

12) Termination

We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms or if necessary to protect the Services, users, or third parties. You may stop using the Services at any time.

13) Changes to the Services or Terms

We may update the Services and these Terms from time to time. The updated Terms will be posted at /terms with the “Last updated” date. Your continued use after changes become effective constitutes acceptance.

14) Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict of laws principles.
